Release and Waiver from Liability
(Inherently Dangerous Activity)
This Release and Waiver of Liability is executed prior to the Participant’s participation in the Airsoft Military Simulation activity (the “Activity”) held at a venue of Green Ops, LLC (“Green Ops”). This agreement remains in effect from the day of signature for one full year.
The Activity is inherently dangerous. Rules and procedures have been established to help make the Activity as safe as possible; however, Green Ops does not claim that such rules and procedures are sufficient in any way to protect the Participant or his/her property from damage, injury, illness, or death. Everyone attending this event is participating at their own risk.
In consideration of being permitted to participate in the Activity, the Participant understands and does hereby freely, voluntarily and without duress execute this Release and Waiver and agrees: An Activity Liability Waiver and Release Agreement must be completed for each Activity the Participant may participate in.
I, the undersigned, wish to participate in the Green Ops activity as referenced above (hereinafter referred to as “Activity”).
I understand and acknowledge that this Activity is voluntary and may be dangerous and hazardous and, by its very nature, poses the potential risk of severe and serious physical and emotional injury/illness, or even death, to all individuals who participate in such Activity. I am aware that no coverage for medical treatment or liability is provided by Green Ops in connection with this Activity.
I understand and acknowledge that in order to participate in this Activity I agree to assume all liability and responsibility for any and all potential risks, injuries, or even death which may be associated with participation of such Activity. I represent and warrant that I am mentally and physically fit, capable, able, and willing to participate in this Activity without any limitations.
I understand, acknowledge, and agree that Green Ops, its employees, agents, coaches, instructors, volunteers, or representatives, including without limitation Derek Chace, shall not be liable for any injury/illness suffered by Participant which is incident to and/or associated with preparing for and/or participating in this Activity.
I hereby release, discharge, indemnify, and agree to hold harmless Green Ops and each of their employees, agents, coaches, instructors, volunteers, and representatives free from any and all liability arising out of or in connection with Participant’s participation in the Activity, including all related activity such as games, practices, training activities, trips, related exercise, or any other activity or event, and covenant not to make or bring any such claims against Green Ops, LLC or any other released person identified in this Agreement.
For purpose of this Release, liability means all claims, demands, losses, causes of action, suits, or judgments of any kind that Participant or Participant’s parents, guardians, heirs, executors, administrators, and assigns may have against Green Ops, its employees, agents, coaches, instructors, volunteers, and representatives because of Participant’s personal, physical, or emotional injury, accident, illness or death, or because of any loss of or damage to property that occurs to Participant or his or her property during Participant’s participation in the Activity that may result from any cause including but not limited to Green Ops, employees, agents, coaches, teachers, volunteers, or representatives own passive or active negligence of other acts other than fraud, willful misconduct or violation of New Hampshire law.
I agree to defend, indemnify, and hold harmless Green Ops and any other released person identified herein against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, the cost of enforcing any right to indemnification under this agreement, arising out of or resulting from any claim of a third party related to my participation in the Activity, including any claim related to my own negligence.
THIS IS A LEGAL DOCUMENT. BY SIGNING IT YOU AGREE TO BE BOUND BY ITS TERMS AND BECOME OBLIGATED TO OR REFRAIN FROM CERTAIN ACTS. READ THE ENTIRE DOCUMENT CAREFULLY BEFORE YOU SIGN IT. IF YOU DO NOT UNDERSTAND ANY PART OF THE DOCUMENT PLEASE SEEK LEGAL ADVICE.
YOU WILL NOT BE ABLE TO PARTICIPATE IN THIS ACTIVITY WITHOUT EXECUTING THIS LEGAL DOCUMENT.
PARTICIPANT AND/OR PARENTS OR GUARDIANS* WHO DO NOT WISH TO ACCEPT THE RISKS DESCRIBED IN THIS AGREEMENT SHOULD NOT SIGN THIS AGREEMENT, AND WILL NOT BE ALLOWED TO PARTICIPATE IN THE ACTIVITY.
I acknowledge that I have carefully read this voluntary activities participation form and that I understand the potential dangers incident to engaging in this Activity, am fully aware of the legal consequences of this agreement, and agree to its terms and understand I am waiving certain rights and assuming the risk of damage from my participation in the Activity.
*If a Participant is a minor, then parent or guardian must sign. If Participant is an adult (18 years of age or older), no signature of parent or guardian is required.
